Successful Outcome for Our Clients in Traffic Accident Case

We are thrilled to announce that our firm has successfully represented Star Nice Enterprise Limited (Plaintiff) and Mr. Cheung (Third Party) and obtained judgment with costs on indemnity basis in the District Court case DCCJ 3427/2022 HKDC 1179.

The case arose from a traffic accident on 4 July 2020, involving the Plaintiff’s private vehicle and a taxi driven by the Defendant, Mr. Lam.  The Plaintiff sought damages for the total loss of the vehicle and incidental expenses, while the Defendant denied liability and attempted to shift liability to the Third Party, Mr. Cheung alleging contributory negligence.

After a full trial, Deputy District Judge Alfred Cheng ruled in favour of the Plaintiff and Third Party, finding the Defendant negligent and dismissing his claims of contributory negligence against the Third Party.  The Court awarded the Plaintiff HK$180,000.00 in damages, including compensation for the loss of the vehicle, towing and handling fees, and survey fees.  Additionally, indemnity costs were ordered against the Defendant for his dishonesty throughout the legal proceedings.
